Terms & Conditions

1.   ‘Your booking‘: When You make a booking with Duffys Car Rentals, we will record “Your request” for a rental vehicle in our booking and will use reasonable endeavours to ensure that a vehicle of the vehicle class booked is available for You at the time nominated in the booking. We will call you or send You a booking confirmation by email (to the email address nominated in the booking) confirming the Pickup Location, Pick Up Time and initial rental charges.

2.   Rental Agreement: Fees that Duffys Car Rentals is entitled to charge without further consent from You other than signing the Rental Agreement are set out in the Pricing on Page 1. Additional fees for optional services or Accessories will be explained to You at the time they are offered to You or are disclosed in the Rental Document. To the extent of any inconsistency between this Rental Agreement and the Terms and Conditions prevail. In these Terms and Conditions:

• ‘AFIA’ mean Australian Finance Industry Association.
• ‘Pick Up Location‘ means the Duffys Car Rentals selected in the booking as the pickup location for the rental vehicle, which is also noted in the booking confirmation.
• ‘Pick Up Time’ means the time nominated in the booking as the time the rental vehicle is to be picked up, which is also noted in the booking confirmation.
• ‘Accessory’ means any equipment set out in the Rental Document, including (as applicable) any global positioning system receiver or similar device, dashcam, or any child restraint, booster, or similar equipment.
• ‘Additional Driver Fee’ means the fee payable by You to Duffys Car Rentals for the addition of an Authorised Driver aside from You.
• ‘Duffys Car Rentals’ means Duffys Car Rentals Pty Limited ABN 32612664043.
• ‘Code’ means the Australian Finance Industry Association (AFIA) Car Rental Code of Practice.
• ‘Collection Costs’ means NT Car Rental’s reasonable costs of collecting unpaid Rental Charges from You.
• ‘Excess Amount’ means the amount incurred as ‘Excess Amount’ after accident.
• ‘Territory’ means Northern Territory or Australian Capital Territory.
• ‘Terrorist Act’ has the meaning in section 100.1 of the Criminal Code Act 1995 (Cth) as of 1 March 2018.
• ‘We’ refers to Duffys Car Rentals Pty Ltd.

3.   Conditions you must meet to be a Renter or an Authorised Driver to rent a Vehicle To be able to rent with Duffys Car Rentals, unless we agree otherwise, the following rental conditions apply. If You as an authorised driver attend an NT Car Rental location to hire a vehicle and You do not meet the below conditions, you may be refused car hire, despite of Your valid booking. Driver Licence: You must present Your current driver licence to the NT Rental Car Rentals representative at the NT Car Rental’s Pick-Up Location and You agree and acknowledge that: only You and/or Your Additional Driver as an Authorised Driver will drive the Vehicle, and You and/or Your Additional Driver as an Authorised Driver hold a current and valid driver licence (not being a learner’s licence or provisional licence) to drive the Vehicle and have been licensed to drive vehicles of the same category as the Vehicle for at least 12 consecutive months immediately before signing the Rental Document and If Your driver licence is not an Australian driver licence, it must be one of a photo licence that is in English, an International Driver Permit or a foreign photo licence with a NAATI certified translation. Your driver licence must be current for the entire period of Your rental and is valid for the class of vehicle that You are renting and Age: You must be at least 25 years of age and below 75 years. Present a valid credit card: must be presented before vehicle picks up, to be used for payment of rentals and any additional rental charges You may incur. If You have made a booking, you must also present the Valid credit card used to pay the rental charges. Good Conduct: The Duffys Car Rentals may refuse to hire You a vehicle if You or your additional driver or anyone in Your party is refused to pay charges or show your driver licence, acting aggressively or inappropriately, appears affected by drugs or alcohol. Additional Driver: Additional fees will apply if You nominate an additional driver. An additional driver is listed on the Rental Agreement and is authorised to drive the rental vehicle subject to the terms of the Rental Agreement. An additional driver must meet Duffys Car Rentals standard rental conditions and is required to sign the Rental Agreement.

4.   Terms related to Where you can and cannot drive the vehicle: You and any Additional driver as an Authorised Driver must only use the Vehicle: and on a road that is properly formed and constructed as a sealed road. in NT, You and any additional driver as an any Authorised Driver must not use the Vehicle off-road (e.g. on a fire trail, beach, track, grassed area or to cross streams or any other body of water) unless You have authorisation from Duffys Car Rentals in writing. You and any additional driver as an any Authorised Driver must not unless authorised in writing by Duffys Car Rentals, drive or take the Vehicle: beyond 120 kilometres of the Darwin city limits between dusk and dawn; or outside any town or city limits between dusk and dawn. in the Katherine region: (i) Central Arnhem Road to Gove beyond Bulman and in the Broome region: (i) on Cable Beach; or (ii) on any other beach in the region; or (iii) on any roads south of Eighty Mile Beach when renting from Hiring Location in Darwin, Northern Territory, Broome WA or Kimberley Region WA. in the Kimberley region: (i) Mitchell Plateau; (ii) Kalumburu; (iii) Kalumburu Road north of Drysdale River Station; (iv) on the Canning Stock Route. on the Tanami Track; or outside any town or city limits between Sunset and Sunrise and in Central Australia: (i) on the Tanami Track west of Rabbit Flat; (ii) on the Gunbarrel Highway; (iii) on the Canning Stock Route; (iv) on the Donahue Highway and in the Northern Territory: on the Jim Jim Falls Road to Jim Jim Falls and Twin Falls; or outside any NT town or city limits between dusk and dawn and Muddy off-road or airside on any airport in Australia unless You have authorisation from NT Car Rental in writing and to the Gove Peninsula or Remote and rural communities of NT and Any island off the coast of Australia (including, but not limited to, Bruny Island, Fraser Island, Groote Eylandt, or the Tiwi Islands) and into or out of Queensland, South Australia, NSW, Victoria, Tasmania, Western Australia.

5.   Conditions of Use of Vehicles: You and any Additional Driver as an any Authorised Driver must: not use, or allow the Vehicle to be used, for any illegal purpose, race, contest or performance test of any kind. not, without NT Car Rental’s prior written consent, use, or allow the Vehicle to be used, to push anything. not carry, or allow the Vehicle to carry, more passengers than may be properly accommodated by the seat belt restraints provided in the Vehicle and must ensure that each passenger in the Vehicle appropriately uses the seat belt restraint. not be under the influence of alcohol, drugs or have blood alcohol or drug content that exceeds the legal limit in the State or Territory in which the Vehicle is driven. not, without NT Car Rental’s prior written consent, use or allow the Vehicle to be used to carry passengers for payment of any kind. not use the Vehicle when it is damaged or unsafe. provided it is reasonable in the circumstances to do so. not drive the Vehicle after an accident or hitting an object (including an animal) until You have obtained NT Car Rental’s prior written consent to do so. not use the Vehicle to transport goods, except in compliance with all necessary approvals, permits, licences and government requirements (to be obtained at Your cost) and following the Manufacturer’s Specifications and Duffys Car Rentals recommendations. not smoke within the Vehicle or allow any other person to smoke within the Vehicle at any time. not, without NT Car Rental’s prior written consent, use the Vehicle to carry any inflammable substance which has a flashpoint under 22.8°C or any other explosive or corrosive substances and not use the Vehicle to prepare, commit or assist in any Terrorist Act and not use the Vehicle for the conveyance or towing of any load unless You have Duffys Car Rentals’ prior written consent; the load is correctly loaded and secured and not over that for which the Vehicle was manufactured; for towing, the vehicle is fitted with a tow bar; and the conveyance or towing is undertaken by the Manufacturer’s Specifications and NT Car Rental’s recommendations. not use the Vehicle in contravention of any law.

6.   Terms and Conditions Associated with Payment Methods & Credit Card Policy: Duffys Car Rentals accept payments by credit card. All cash payments require prior approval. Payments are accepted by credit card (Visa and Mastercard only). Duffys Car Rentals require customers to present the physical card used to make payment at the location. Credit Cards: Duffys Car Rentals accept only Visa and Mastercard whereas American Express. Diners Club is not accepted. No other credit cards are accepted. All credit cards used must be bank-issued. Presentation of Credit Card at Vehicle Pick Up: When picking up the vehicle, you must present a physical credit card, to be used for payment of rentals or any additional rental charges You may incur. credit card in another name may be accepted, however, the cardholder must complete Our credit card authorisation form and present acceptable identification in person at a Duffys Car Rentals location before vehicle pick up and Single vehicle accidents: If damage to the rental vehicle is caused in an incident where no other vehicle or third party property is involved, our member will debit your credit card for the lesser of:(a)their damage liability fee/excess/single vehicle accident fee (if applicable) payable according to their customer's contract; or (b)the repair cost if the vehicle is repairable or the total loss value of the vehicle if it is not. Thefts: If You report the rented vehicle has been stolen our member will be permitted to debit their customer's credit card or approved debit card for the damage liability fee/excess payable according to their contract. We will make proper enquiries with the relevant authorities with a view to recovering the vehicle. If the vehicle is recovered, we will refund the amount of the damage liability fee/excess subject to any deductions for damage arising from the condition in which the vehicle is found because of the theft. Accidents involving third parties: (a) If you report in writing that a third party has been involved in an accident, our member will take reasonable steps to determine fault and where practicable, obtain an admission from the third party's insurer. (b)If we will obtain that admission and you are ordinarily resident in Australia and has an Australian driver's licence, we will not debit their customer's credit card.

7.   Maintenance, security, and cleaning: You and Additional driver as an Authorised Driver must: maintain all the Vehicle’s engine oils and engine coolant levels to the Manufacturer’s Specifications, provided that Duffys Car Rentals has provided the Vehicle to You with engine oils and engine coolant at levels which reflect the Manufacturer’s Specifications. keep the Vehicle locked when it is unattended and the keys under Your or the Authorised Driver’s control at all times. comply with all applicable seat belt and child restraint laws and For each roadside assistance, callout for a fault or incident caused by Your act or omission (including, but not limited to emergency refuelling (up to an amount required to reach the nearest petrol station), a tyre-related incident, lost keys, keys locked in the vehicle, or a flat batter where Roadside Assistance Cover does not apply if the Vehicle has been used in breach of clause 5 or 7 iv. You must not have repairs to the Vehicle carried out unless Duffys Car Rentals You to do so in writing. Duffys Car Rentals requires verification of the cost of repairs for reimbursement and GST purposes. You should obtain an original tax invoice/receipt from the repairer to assist Duffys Car Rentals. Duffys Car Rentals will reimburse You for any repairs to the Vehicle authorised by Duffys Car Rentals in writing, if Duffys Car Rentals can verify the cost of those repairs. To the extent that Duffys Car Rentals cannot verify the cost of repairs, Duffys Car Rentals will not reimburse You. The period in breach of clause 5 or returned the Vehicle in an excessively poor condition (excluding Smoking odour or food or liquor spill or Fair Wear and Tear); You may be required to pay the cost of any professional cleaning or odour extraction reasonably incurred by Duffys Car Rentals and a reasonable administrative fee reflecting the cost of making arrangements for professional cleaning or odour extraction. Fair Wear and Tear Guide: Damage caused intentionally or by gross negligence is never fair wear and tear and is excluded from the damage cover that we offer to you and You should always refer to the full Terms and Conditions of Rental for a full understanding of the BELOW inclusions and exclusions that apply to your rental according to AFIA Car Rentals Code of Practice (https://afia.asn.au/files/galleries/AFIA_Car_Rental_Code_of_Practice.pdf). If you have any questions, please contact us directly or ask a member of staff at the rental location.

8.   Rental Charges and Payments: Final Rental Charges: At the end of the Rental Period, you must pay, and We will charge You: All Rental Charges calculated based on the actual period of the rental (being the period from the actual pick up time to the actual return time), less any amount paid at the start to the rental and Any charges payable for roadside assistance and Any Cleaning Fees applicable according to clause 8 and all other reasonable costs required to return the Vehicle and any equipment supplied to the same condition it was in at the commencement of the rental following clause and Any amount payable concerning tolls or infringements and Any amounts payable concerning Damage or loss or theft of the Vehicle as per drop off inspection. All applicable card payment fees; and Any other amount payable under the Rental Agreement. Summary of Rental Charges: Rental Charges payable comprise the following charges (as applicable): Base rental rate means the base daily rate for the rental. Vehicle Registration Recovery Fee means the daily amount payable to Us to recover Our costs of registering and licensing the Vehicle as a rental vehicle. Cost of hiring any additional equipment You have requested. Cost of any Additional Damage Protection or Recovery Plus Protection You have selected.

Administration Fee - the fee charged by Us for the administrative costs associated with Your rental. The fee is 3.5% of all Rental Charges (plus GST). Additional Driver Fee means a daily fee charged for adding Driver to the Rental Agreement (subject to Our approval). Excess Kilometre Charge means the charges payable if You exceed any free kilometre’s allowance specified in the Rental Details Document. We will use the Vehicle’s odometer to calculate the number of kilometres travelled during the rental. The rate for each additional kilometre is specified in the Rental Details Document where applicable. Fuel charges means The Vehicle is supplied with a full tank of fuel. If You return the Vehicle without a full tank of fuel, a refuelling charge will apply which will include fuel cost plus labour time cost to refuel the vehicle. At some Hiring Locations a Prepaid Fuel option may be available allowing You to pay for fuel usage in advance eliminating the need to pay for fuel at the end of Rental. Unused fuel which has been prepaid will not be refunded. You must also pay for any fuel used for any delivery and collection service We agree to provide You.

Any additional fees which apply from time to time as advised by Us at or before the time of entry into this Rental Agreement. Calculation of daily Rental Charges The daily base rental rate is charged per 24-hour period commencing on the date and time the vehicle is picked up. For part periods (for example when Your Rental Period exceeds any whole 24-hour period), the first additional 59 minutes attracts no additional charge. Where the period of the rental exceeds any whole 24-hour period by one hour or more We will charge the following additional amount: one-third of the applicable daily base rental rate for 1 hour or more but less than 2 hours. two-thirds of the applicable daily base rental rate for 2 hours or longer but less than 3 hours; and the entire daily base rental rate for 3 hours or more. All other Rental Charges which are a daily charge such as the Additional Driver Fee. Fines and Infringements: You or your additional driver are liable for and must pay all fines and infringements incurred during Your rental of the Vehicle, including all speeding and traffic fines, infringements, and penalties and You or your additional driver are liable for and must pay all fines, infringements and penalties arising from parking, clamping, towing, or release of the Vehicle from compounds and We may supply Your details to any regulatory authority issuing a fine or infringement notice incurred during the period of Your rental. Each time We do so We will charge an infringement administration fee in the amount shown on the Rental Details Document (including GST). If We have paid the amount of any fine, infringement or penalty that You are liable for under clause 8, We will also charge You that amount.

9.   Conditions Associated with the return of the vehicle: You must return the Vehicle to Duffys Car Rentals: to the place, on the date and by the time shown on the Rental Document unless You have informed Duffys Car Rentals of a change before the return date and time and Duffys Car Rentals has agreed to the change; and in the same condition, as it was at the commencement of the Rental Period, Fair Wear and Tear excepted and If You tell Duffys Car Rentals that You wish to return the Vehicle to a location other than that stated on the Rental Document, Duffys Car Rentals will advise You of the amount of the ‘one-way fee’ that You will incur. If You do not tell Duffys Car Rentals in advance, you must pay a ‘one-way fee’ of up to $2 per kilometre (depending on the type of vehicle and the distance travelled) to be determined and paid at the end of the Rental Period. You will also be liable for any Rental Charges calculated under the clause and If You: return the Vehicle later or time than that shown on the Rental Document or return the Vehicle to a place other than that shown on the Rental Document; or do not comply with any special conditions set out in the ‘Rates’ section on the Rental Agreement, the rates are shown on the Rental Agreement may not apply and You must pay the rate that is reasonable in the circumstances for the Vehicle for the Rental Period as well as the Late Return Charge. If You do not return the Vehicle on the date and by the time shown on the Rental Agreement (or any extended date or time agreed with Duffys Car Rentals in writing) then: after written notice to You and if the location of the Vehicle is unknown, Duffys Car Rentals may report the Vehicle as stolen to the police; and You must pay Duffys Car Rentals all Rental Charges (including additional Rental Charges) and compensate Duffys Car Rentals following clause for any loss Duffys Car Rentals suffers (including all reasonable additional costs Duffys Car Rentals incurs in recovering the Vehicle) up to the time that the vehicle is recovered by Duffys Car Rentals. the Rental Period expires without satisfactory arrangements having been made by You with Duffys Car Rentals; or Duffys Car Rentals reasonably suspects that: the Vehicle may be used for any unlawful purpose; damage to the Vehicle, or injury to persons or property, is likely to occur; or the Vehicle will be involved in an industrial dispute and downtime of the Vehicle (or, where the actual downtime of the vehicle is not known, a reasonable estimate of that downtime).
